The Rules Governing Use of the Jaganify.ai Platform

1. Acceptance of Terms 

These Terms of Service (“Terms”) constitute a legally binding agreement between you and Jaganify.ai (“Company,” “we,” “us,” or “our”). By registering as a host, scanning a QR code as a guest, or otherwise accessing the Jaganify.ai platform, you agree to be bound by these Terms. 

If you do not agree to these Terms, you must not use the platform. We reserve the right to modify these Terms at any time with reasonable notice to active users. 

2. Platform Description 

Jaganify.ai provides a Smart Guest Assistant platform that allows property hosts to: 

  • Register properties and create AI-powered guest assistants 
  • Generate QR codes for guest access 
  • Provide guests with property information, local recommendations, and support via AI chat and voice 
  • Manage subscriptions and access analytics 

Guests access the platform by scanning a property QR code and interacting with an AI assistant powered by third-party AI services including OpenAI, Google Gemini, Anthropic Claude, and others. 

3. Host Accounts and Eligibility 

3.1 Eligibility 

To register as a host, you must be at least 18 years of age, have legal authority to manage the properties listed, and comply with all applicable local laws and regulations regarding short-term rentals. 

3.2 Account Registration 

Hosts must provide accurate and complete information during registration, including name, email, and required verification documents. You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately at support@jaganify.ai if you suspect unauthorized access to your account. 

3.3 Account Approval 

Host accounts and property listings are subject to admin review and approval. We reserve the right to reject or remove any account or listing that violates these Terms, applicable laws, or our community standards, without obligation to provide specific reasons. 

4. Guest Access 

4.1 QR Code Access 

Guests access the Smart Guest Assistant by scanning a property-specific QR code. Guest access is limited to the property for which the QR code was generated. 

4.2 Guest Conduct 

Guests must not: 

  • Submit queries intended to extract harmful, illegal, or inappropriate information from the AI 
  • Attempt to manipulate, jailbreak, or misuse the AI assistant 
  • Share QR codes with individuals not staying at the property (unless authorized by the host) 
  • Use the platform for any purpose other than obtaining legitimate guest assistance 

4.3 Guest Acknowledgment 

Guests acknowledge that AI responses are generated by automated systems and may not always be accurate, complete, or current. Guests should verify critical information (such as emergency contacts or local regulations) through independent sources. 

5. Host Responsibilities 

5.1 Accuracy of Property Information 

Hosts are solely responsible for the accuracy, completeness, and legality of all information provided on the platform, including property descriptions, house rules, local area guides, Wi-Fi credentials, and emergency contacts. 

5.2 AI Training Content 

Hosts acknowledge that information they input into Jaganify.ai may be used as context in AI prompts to generate guest responses. Hosts must not input: 

  • False or misleading information 
  • Content that violates third-party intellectual property rights 
  • Illegal content of any kind 
  • Content designed to deceive or harm guests 

5.3 Regulatory Compliance 

Hosts are solely responsible for compliance with all local, state, and national laws governing short-term property rentals, including obtaining required permits, licenses, and paying applicable taxes. Jaganify.ai does not provide legal, tax, or regulatory advice. 

5.4 Guest Interaction 

The AI assistant is a supplement to, not a replacement for, host communication. Hosts remain responsible for responding to guest emergencies, safety concerns, and situations requiring human judgment. 

5.5 Wi-Fi Network Security 

Hosts who use the Wi-Fi auto-connect feature are responsible for maintaining the security of their Wi-Fi networks, ensuring appropriate password protection, and complying with any applicable internet service provider terms of service. 

6. Subscription Plans and Payments 

6.1 Available Plans 

Jaganify.ai offers the following subscription tiers: 

  • Basic Plan ($4.99/month): 1 property, text-only AI, 50 guest messages/month, QR code activation, email support 
  • Pro Plan ($19.99/month): Up to 5 properties, text + voice AI, 500 guest messages/month, analytics dashboard, priority support 
  • Business Plan ($99/month): Unlimited properties, text + voice + SMS, custom branded assistant, advanced analytics, dedicated account manager, bulk QR code management 

6.2 Billing 

Subscriptions are billed monthly in advance. Payments are processed securely through Stripe. By providing payment information, you authorize recurring charges for your selected plan. 

6.3 Cancellation and Refunds 

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial months, except where required by applicable law. 

6.4 Plan Changes 

You may upgrade or downgrade your plan at any time. Upgrades take effect immediately; downgrades take effect at the next billing cycle. Overuse of plan limits (e.g., exceeding message quotas) may result in service throttling or a prompt to upgrade. 

6.5 Price Changes 

We reserve the right to modify pricing with 30 days’ written notice to active subscribers. Continued use after the notice period constitutes acceptance of the new pricing. 

7. QR Code Terms 

  • QR codes are unique to each approved property and may only be used for that property. 
  • Hosts may not transfer, sell, or sublicense QR codes to third parties. 
  • Bulk QR codes purchased for pre-sale activation (e.g., through partner programs) are governed by additional terms provided at the time of purchase. 
  • QR codes become inactive if the associated subscription lapses, the property is unapproved, or the host account is suspended. 
  • Jaganify.ai reserves the right to deactivate QR codes that are being misused or abused. 

8. Third-Party AI Services 

The Smart Guest Assistant integrates AI services from third-party providers. You acknowledge and agree that: 

  • AI responses are generated algorithmically and may contain errors, outdated information, or irrelevant content. 
  • Jaganify.ai does not guarantee the accuracy, safety, or completeness of AI-generated responses. 
  • Third-party AI providers (OpenAI, Google, Anthropic, and others) have their own terms of service and acceptable use policies, which apply to your use of the platform. 
  • We may change AI providers at any time without notice, provided that service functionality is substantially maintained. 
  • Jaganify.ai is not liable for any harm arising from reliance on AI-generated content. 

9. Prohibited Uses 

You agree not to use Jaganify.ai to: 

  • Violate any applicable law or regulation 
  • Infringe on the intellectual property rights of others 
  • Harass, threaten, or harm other users 
  • Distribute spam, malware, or harmful code 
  • Attempt to gain unauthorized access to our systems or other users’ accounts 
  • Circumvent usage limits, rate limits, or subscription restrictions 
  • Use the platform for purposes other than lawful vacation rental management and guest assistance 
  • Input sensitive personal data (Social Security numbers, financial account details, medical information) into AI chat 

10. Intellectual Property 

10.1 Jaganify.ai IP 

All content, features, software, and branding of Jaganify.ai are owned by us or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written consent. 

10.2 Host Content License 

By uploading property information, photos, and other content to Jaganify.ai, hosts grant us a non-exclusive, royalty-free license to use, display, and process that content solely for the purpose of operating and improving the platform. 

10.3 Feedback 

If you provide feedback or suggestions about the platform, you grant us the right to use such feedback without restriction or compensation. 

11. Disclaimers 

THE JAGANIFY.AI PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE SPECIFICALLY DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. 

12. Limitation of Liability 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JAGANIFY.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR PROPERTY DAMAGE, ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM. 

13. Indemnification 

You agree to indemnify, defend, and hold harmless Jaganify.ai, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from: (a) your use of the platform; (b) your violation of these Terms; (c) your violation of any applicable law; (d) your property operations or guest relationships; or (e) any content you provide to the platform. 

14. Governing Law and Disputes 

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in court for IP violations or unauthorized access. 

15. Termination 

We reserve the right to suspend or terminate your account at any time for violation of these Terms, illegal activity, non-payment, or for any reason with 14 days’ notice. Upon termination, your right to use the platform ceases immediately. Provisions that should survive termination (IP, indemnification, limitation of liability) will do so.
